ConCourt orders Woolworths to reinstate workers after 16 years

Retailer says jobs no longer exist.

The SA commercial and catering workers union has succeeded in having dozens of employees – dismissed by Woolies in 2002 – reinstated by the Constitutional Court. The union approached the top court after a decision by the labour appeal court only awarded workers remuneration compensation for being unfairly dismissed. 

Mike Tau, second deputy president of  (Saccawu) says the Constitutional Court ruling has set a precedent for employers who think consultation justifies dismissing workers unfairly.
