EXPLANATORY NOTES FOR THE RESIDENTIAL LEASE AGREEMENT TO WHICH THE CONSUMER PROTECTION ACT DOES NOT APPLY
This agreement is drafted in favour of the lessor (the landlord). It is, however, fair and equitable to the lessee.
This agreement should be used in instances where a landlord wishes to lease a town-house, flat, garden cottage and such like to a lessee on a once-off basis, i.e. such leasing arrangement must not be as part of a rental business undertaking operated by the landlord. The landlord is advised to do a credit check on the lessee and to obtain at least three cogent references.
Please do not use this lease agreement, if the residential property is being leased pursuant to a rental business conducted by the landlord, and where such residential property is being leased to a “consumer” as defined in the Consumer Protection Act. There are CPA residential leases available on this site for CPA residential letting.
